Terms of Service

1. The service
CareFam is a software tool that helps a family share caregiving information about an elderly relative. It is not a medical device, it does not give medical advice and it must never replace a qualified physician. In an emergency call 112 in the EU, 119 in Japan or your local emergency number.
2. Eligibility
You must be at least 18 years old to register. The person being cared for can be of any age provided you have legal authority to act on their behalf.
3. Family groups
The person who creates a group is the Owner. The Owner approves new members by code, can revoke access and is responsible for content and consent inside the group. By inviting another member you confirm you have lawful basis to share the patient’s health data with that member.
4. Subscription
Paid plans renew automatically through your Apple ID. Prices, currency and renewal date are shown by Apple before purchase. You may cancel at any time in iOS Settings → Apple ID → Subscriptions; cancellation takes effect at the end of the current period.
5. Refunds
Refunds are governed by Apple’s terms and processed by Apple. We cannot issue refunds directly. EU consumers retain their statutory rights under Directive 2011/83/EU.
6. Acceptable use
You must not upload illegal content, impersonate a healthcare professional, use the app to harass another person, or attempt to access another family’s data. We may suspend accounts that breach these terms.
7. Intellectual property
The app, the brand and the website are owned by NextCode. The content you log is yours; we hold a limited licence only to display it to your family group and operate the service.
8. Disclaimer
The service is provided “as is”. We do not warrant that medication reminders will arrive on time in every condition (a phone may be off, a notification may be silenced). You remain solely responsible for medical decisions.
9. Liability
To the maximum extent permitted by law our aggregate liability is limited to the amount you paid us in the 12 months before the event. Nothing in these terms limits liability for fraud, gross negligence or wilful misconduct, nor for personal injury caused by negligence where this cannot be excluded by law.
10. Governing law
Japanese law applies, with non-exclusive jurisdiction of the courts of Tokyo. Consumers domiciled in Italy, Spain or another EU country may rely on the mandatory protection of their place of residence (Reg. EU 1215/2012).
